1. Identification of the provider
1.1. These Terms and Conditions govern the access, browsing, use and purchase of products through the website c16beauty.com (hereinafter, the "Website"), operated under the trade name C.16 Beauty Studio, dedicated to the sale of professional hair care and treatment products within the territory of the Republic of Ecuador.
1.2. The provider and party responsible for the online store is José Gregorio Loyo Ybáñez, holder of RUC (taxpayer ID) No. 1761401130001, domiciled at the Cosmopolitan Parc Building, 3rd floor, office 307, Quito, Ecuador, who acts as the party responsible for the commercial operation of the Website, customer service, invoicing and compliance with the applicable legal obligations.
1.3. The brands, trade names, logos and other distinctive signs of the products offered belong to their respective owners. Their use on the Website is exclusively for informational and descriptive purposes and to identify the products sold. C.16 Beauty Studio has no affiliation, representation, sponsorship or special authorization from the owners of such brands, unless expressly stated otherwise.
2. Acceptance of the Terms
2.1. By accessing the website, creating an account, browsing, adding products to the cart or making a purchase, the user declares that they have read, understood and accepted these Terms and Conditions, the Privacy Policy, the Cookie Policy, the Shipping Policy and the Returns and Refunds Policy.
2.2. If the user does not agree with the policies, they must refrain from using the store or making purchases through it.
2.3. Contracts entered into by electronic means will be considered valid in accordance with Ecuadorian regulations on data messages, electronic contracting and consumer protection. Electronic contracts do not lose validity for having been formed through data messages.
2.4. C.16 Beauty Studio may update or modify these Terms and Conditions to adapt them to legal, technological, operational or commercial changes. The modifications will be published on the Website and will take effect upon publication, unless a different date is expressly indicated.
2.5. Modifications will not affect orders already confirmed prior to the effective date of the changes, unless a legal provision requires otherwise.
3. Users and legal capacity
3.1. The Website is aimed primarily at consumers located in the Republic of Ecuador and at persons who have the capacity to enter into legal acts in accordance with the applicable legislation.
3.2. To make purchases through the Website, the user declares that they are of legal age and have the legal capacity to contract. When acting on behalf of a third party or a legal entity, they declare that they have the necessary powers to do so. Minors may only use the Website under the supervision and responsibility of their legal representative.
3.3. C.16 Beauty Studio may reject, suspend or cancel orders, accounts or transactions when it detects false or inaccurate information, misuse of the Website, reasonable indications of fraud, breach of these Terms and Conditions, inability to verify the information provided by the user or logistical impossibility of completing the delivery.
4. User account
4.1. The user may purchase as a guest or by creating an account, depending on the functionalities available in the store.
4.2. To create an account, data such as name, email address, telephone number, shipping address, order history and access credentials may be requested.
4.3. The user is responsible for maintaining the confidentiality of their credentials and for all activity carried out from their account.
4.4. The user undertakes to provide truthful, complete, up-to-date and lawful information. C.16 Beauty Studio will not be liable for delays, failed deliveries or errors arising from incorrect information provided by the user.
4.5. The user undertakes to immediately report any unauthorized access, misuse or reasonable suspicion of a breach of the security of their account through the contact channels enabled by C.16 Beauty Studio.
4.6. C.16 Beauty Studio may suspend or cancel accounts when it detects false information, fraudulent activities, breach of these Terms and Conditions or any conduct that may affect the security, integrity or operation of the Website.
4.7. The creation of an account does not guarantee the acceptance of orders, which will be subject to product availability, validation of the information provided and other applicable conditions established in these Terms and Conditions.
5. Products
5.1. C.16 Beauty Studio offers professional hair care products. The characteristics, presentation, availability, price, instructions for use, warnings and other relevant information will be indicated on each product's page, on the manufacturer's label or in the information available before purchase.
5.2. Product images are for reference. There may be reasonable variations in color, packaging, presentation or design due to manufacturer changes, provided they do not affect the essential nature of the product.
5.3. The user must review ingredients, warnings, instructions for use, expiration date, compatibility and manufacturer recommendations before using any product.
5.4. The products offered do not constitute a diagnosis, medical treatment or personalized dermatological or health recommendation. In case of allergies, sensitivity, scalp conditions, pregnancy, breastfeeding, medical treatments or doubts about the use of a product, the user should consult a competent professional.
5.5. All orders are subject to inventory availability at the time of processing. Adding a product to the shopping cart does not guarantee its availability or reservation.
5.6. In the event of unavailability of a product after an order has been placed, C.16 Beauty Studio will inform the customer as soon as possible and may offer, as applicable:
- a) A refund of the amount paid;
- b) Substitution with an equivalent product, subject to the customer's acceptance; or
- c) Any other solution agreed between the parties.
6. Prices, taxes and promotions
6.1. Prices are published in United States dollars, legal tender in Ecuador.
6.2. The published prices correspond to the applicable sale value in accordance with the current tax regime of the party responsible for the Website. Sales receipts will be issued by José Gregorio Loyo Ybáñez, RUC No. 1761401130001, applying the current Value Added Tax (VAT/IVA) rate of 15% on taxed goods, in accordance with Ecuadorian tax regulations, except in cases where the law expressly provides a different rate.
6.3. The total value of the purchase, including products, taxes, discounts, shipping costs and any applicable charges, will be communicated before the order is confirmed.
6.4. Shipping will be free for purchases of $50 or more, in accordance with the conditions published by C.16 Beauty Studio. For purchases below that amount, the shipping cost communicated before completing the purchase will apply.
6.5. Promotions, discounts or special offers will be subject to validity periods, availability, stock, specific conditions and restrictions communicated to the consumer before purchase.
6.6. C.16 Beauty Studio may correct obvious errors in price, description or availability before confirming the order. If the order has already been paid and cannot be processed due to an obvious error or lack of stock, C.16 Beauty Studio will inform the customer and process the return of the amount paid in accordance with the Returns and Refunds Policy.
7. Purchase process
7.1. To make a purchase, the user must select the products of interest, add them to the cart, provide the requested information, review the order summary, select the available payment method and confirm the purchase.
7.2. Receipt of a purchase order does not imply final acceptance of the order. Acceptance will occur when C.16 Beauty Studio confirms the corresponding payment and the availability of the requested products.
7.3. C.16 Beauty Studio may contact the user to validate information related to the order, delivery address, product availability, payment or any other data necessary for the correct execution of the purchase.
7.4. The user must carefully review the order before confirming it. Once confirmed, changes will be subject to the preparation status, dispatch and operational availability.
7.5. If it is not possible to process the order due to lack of availability, obvious errors in the transaction information, inability to validate it or any circumstance preventing its execution, C.16 Beauty Studio will inform the user in a timely manner and proceed in accordance with the applicable return or refund policies.
8. Payment methods
8.1. Credit or debit card payments are processed through the PayPhone payment gateway.
8.2. C.16 Beauty Studio does not store complete credit or debit card data. Such data is entered and processed directly by PayPhone or by the intervening financial providers.
8.3. C.16 Beauty Studio may receive limited information about the status of the transaction, including approval or rejection of the payment, transaction identifier, amount, date and other data necessary for reconciliation, invoicing, customer service and compliance with legal obligations.
8.4. Payments may be deferred in up to twelve (12) installments when that option is available through PayPhone and the card-issuing financial institution. Approval of the deferral, as well as interest, finance charges, fees and other applicable conditions, will be determined exclusively by the corresponding financial institution.
8.5. C.16 Beauty Studio will communicate the sale price and the applicable total value before completing the purchase. Interest, finance charges, deferral approvals, reversals or any condition associated with financing depend exclusively on PayPhone and/or the corresponding financial institution.
8.6. Payment methods and collection conditions will be subject to the applicable Ecuadorian regulations on consumer protection, payment services and electronic commerce.
9. Invoicing
9.1. C.16 Beauty Studio will issue the corresponding sales receipt in accordance with the Ecuadorian tax regulations in force and the tax regime applicable to the party responsible for the Website.
9.2. The user must provide complete, accurate and up-to-date information for the issuance of the sales receipt, including name or company name, identity card or RUC number, email address, address and any other data required by the applicable tax regulations.
9.3. The user must verify the billing information before confirming their purchase. Errors in billing data must be reported through C.16 Beauty Studio's service channels within five (5) business days following the issuance of the sales receipt, and their correction will be subject to the procedures and limitations established by the Ecuadorian tax regulations in force.
10. Shipping
10.1. C.16 Beauty Studio ships only within the continental territory of the Republic of Ecuador. Shipments are not made to the province of Galápagos.
10.2. Shipments are managed through couriers or external logistics providers selected by C.16 Beauty Studio.
10.3. Coverage areas, estimated delivery times, shipping costs, operational restrictions, delivery attempts and other applicable conditions are detailed in the Shipping Policy, which forms an integral part of these Terms and Conditions.
10.4. The user is responsible for providing a complete, exact and accessible delivery address, as well as up-to-date contact information. If the order cannot be delivered due to errors in the data provided, absence of the recipient, inability to access the delivery location or another cause attributable to the user, additional re-shipment or handling costs may be generated, which will be communicated to the customer before proceeding with a new delivery.
11. Returns, exchanges and refunds
11.1. Returns, exchanges and refunds will be governed by the Returns and Refunds Policy and by Ecuadorian consumer protection regulations.
11.2. The consumer may exercise the return or exchange rights recognized by Ecuadorian legislation within the legally applicable periods and conditions, provided that the nature of the product permits it and it is kept in the same condition in which it was received.
11.3. Due to the nature of the hair and cosmetic products sold by C.16 Beauty Studio, returns will not be accepted for products that have been opened, used, handled, altered, that lack their original seals, have damaged containers, contamination or missing items, or that are not in the same condition in which they were delivered, except in cases of defective products, dispatch errors or where a legal warranty applies.
11.4. When a monetary refund is legally due, it will be made using the same payment method used by the customer or through another mechanism permitted by the applicable regulations. C.16 Beauty Studio will not substitute the refund with credit notes, products or compensatory services without the consumer's express acceptance.
12. AI virtual assistant "Arthur"
12.1. C.16 Beauty Studio may make available to users a virtual assistant based on artificial intelligence called "Arthur", intended to answer general questions about products, hair routines, product availability, the operation of the Website and purchase guidance.
12.2. Arthur may interact with users by text and, when enabled, through voice tools. Specialized artificial intelligence and voice processing technology providers may be involved in its operation.
12.3. The user undertakes not to enter through Arthur sensitive or unnecessary information, including, among others, medical data, diagnoses, severe allergies, information about minors, full payment card numbers, passwords or other data whose disclosure is not necessary for handling the inquiry.
12.4. The answers provided by Arthur are exclusively informational and indicative. Arthur does not replace the judgment, diagnosis, treatment or recommendation of health, dermatology, cosmetology or professional hairstyling professionals, nor the instructions provided by product manufacturers.
12.5. Conversations with Arthur may be processed to answer inquiries, improve service, maintain service security and document requests, in accordance with the Privacy Policy.
12.6. Arthur must not be used to carry out unlawful acts, violate third-party rights, extract unauthorized information, manipulate the site or attempt to circumvent security controls.
13. Permitted use of the site
13.1. The user undertakes to use the Website lawfully, responsibly, respectfully and in accordance with the applicable legislation, these Terms and Conditions and the other policies published by C.16 Beauty Studio.
13.2. The user is prohibited from:
- Using the Website for fraudulent or unlawful purposes or purposes contrary to good faith.
- Impersonating identities, using third-party information without authorization or providing false, inaccurate or misleading data.
- Attempting to access without authorization computer systems, accounts, databases, servers or any technology infrastructure related to the Website.
- Introducing, transmitting or distributing viruses, malware, malicious code, harmful programs or any tool that may affect the security, integrity or operation of the Website or of third parties.
- Copying, reproducing, distributing, extracting, scraping, commercially exploiting or using content from the Website without the prior and express authorization of C.16 Beauty Studio or its respective owners.
- Interfering with, altering or affecting the operation of the Website, the PayPhone payment gateway, the virtual assistant Arthur or any technology provider linked to the provision of the services.
- Making purchases using unauthorized payment methods, third-party financial information without authorization or mechanisms associated with fraud or unlawful activities.
13.3. Breach of the provisions of this section may result in the suspension or cancellation of accounts, orders or access to the Website, without prejudice to any legal actions that may apply.
14. Intellectual property
14.1. The content of the Website, including texts, images, photographs, designs, logos, interface, databases, software, catalogs and other elements belonging to C.16 Beauty Studio, is protected by the applicable intellectual property rules and belongs to C.16 Beauty Studio, to José Gregorio Loyo Ybáñez, to its suppliers or to third parties who have authorized its use.
14.2. The brands, trade names, logos and other distinctive signs of the products sold through the Website belong to their respective owners and are used only for purposes of identification, information and sale of the products offered.
14.3. Access to or use of the Website does not grant the user any intellectual property right, license or authorization over the content, brands or protected elements found on it.
14.4. The user may not reproduce, distribute, modify, publicly communicate, reverse engineer, commercially exploit or use in any way the content of the Website without the prior, express and written authorization of the corresponding owner.
15. Personal data protection
15.1. The processing of personal data carried out through the Website will be performed in accordance with the Privacy Policy of C.16 Beauty Studio, the Organic Law on Personal Data Protection of Ecuador and other applicable regulations.
15.2. Users may exercise the rights recognized by personal data protection regulations, including, as applicable, the rights of access, rectification and updating, deletion, objection, portability, suspension of processing and other legally recognized rights, by submitting a request through the contact channels indicated in the Privacy Policy.
15.3. The exercise of these rights will be subject to the procedures, requirements and periods established by the applicable regulations and may require verification of the requester's identity to protect the security of the information and the rights of third parties.
16. Cookies
16.1. C.16 Beauty Studio uses cookies and similar technologies necessary for the operation of the Website, session management, user authentication, platform security and the operation of the shopping cart. It may also use analytics, performance or additional functionality cookies when the user has given their consent or when another legal basis provided for in the applicable regulations exists.

17. Liability
17.1. C.16 Beauty Studio will endeavor to keep the Website available, secure and up to date. However, it does not guarantee the absence of interruptions, technical errors, connectivity failures, scheduled maintenance, force majeure events, acts of third parties, incidents involving technology providers, payment gateways, hosting services, couriers or other circumstances beyond its reasonable control.
17.2. C.16 Beauty Studio will not be liable for damages arising from the improper use of the products, from failure to follow the instructions, warnings or recommendations provided by the manufacturer, from allergies, sensitivities or particular reactions unknown to the customer, from incorrect professional use, from combinations or applications not recommended, or from the handling, storage or preservation of the products after delivery.
17.3. C.16 Beauty Studio does not guarantee that the information provided by the virtual assistant Arthur or by any informational content on the Website is applicable to all particular situations of users, so decisions made based on such information will be the sole responsibility of the user.
17.4. Nothing in these Terms and Conditions shall be construed as a limitation, waiver or restriction of the non-waivable rights that Ecuadorian legislation grants to consumers.

18.2. C.16 Beauty Studio will handle users' inquiries and claims in accordance with the applicable Ecuadorian regulations, endeavoring to provide a response within reasonable periods according to the nature of each request.
18.3. Filing a claim through C.16 Beauty Studio's service channels does not limit the consumer's right to turn to the competent authorities or exercise the protection mechanisms provided for in Ecuadorian legislation.
19. Governing law and jurisdiction
19.1. These Terms and Conditions will be governed by and construed in accordance with the laws of the Republic of Ecuador.
19.2. In the event of a dispute related to the access to or use of the Website or the purchase of products, the parties will endeavor to resolve it directly and in good faith through the service channels enabled by C.16 Beauty Studio.
19.3. Notwithstanding the foregoing, the consumer will retain at all times the right to file claims or bring any actions they consider appropriate before the administrative or judicial authorities or protection mechanisms provided for in Ecuadorian legislation.
19.4. Nothing in these Terms and Conditions shall be construed as a waiver of rights recognized by consumer protection legislation, a mandatory imposition of arbitration or mediation, or an undue limitation of access to the competent authorities or the exercise of legal actions.
20. Modifications
20.1. C.16 Beauty Studio may modify these Terms and Conditions to reflect legal, regulatory, operational, technological, commercial or security changes, or any other circumstance justifying their update.
20.2. The current version of the Terms and Conditions will be available on the Website and will include the date of its last update.
20.3. Purchases made and confirmed prior to the entry into force of a modification will be governed by the Terms and Conditions in force at the time of purchase, unless the applicable regulations provide otherwise or the modification is more favorable to the consumer.
